Lennington appointed a panel of three fellow Circuit Court judges -- Democrats Marianne Vorhees, Richard Daily and Robert Barnet Jr. -- for Democrats and Republicans to choose from.
Democrats struck Barnet from the panel and Republicans struck Dailey, leaving Vorhees.
Vorhees, however, declined to accept jurisdiction, citing a conflict of interest in the case. Vorhees' father-in-law is Charles 'Chic' Clark, a Republican city attorney.
The responsibility for finding a judge now comes to Delaware County Clerk Steve Craycraft."
