"Again, so what? Many, perhaps most, Americans, foggy about the workings of their government, think that overturning Roe would make abortion, one of the nation's most common surgical procedures, illegal everywhere. All it actually would do is restore abortion as a practice subject to state regulation. But because Californians are content with current abortion law, their legislature probably would adopt it in state law."With that Will exposes what the radicals on both sides of the abortion debate obscure - that the right will go back to the states and each state makes it own decision. On a theoretical level, I have no problem with this scenario. I think most people and, thus, most states will not follow the hardcore pro-lifers.
What I do not like is the idea that a federal right to privacy is a bad thing. That conservatives always preach about the evils of Big Government never liked the idea of shielding the citizenry's privacy from that Big Government ought not surprise me. I suppose I am as shocked as Captain Renault was shocked by gambling at Rick's Cafe Americain.
Will also exposes the falsity of the Republicans as the pro-life party by what he does not mention. The Republicans never offered a constitutional amendment overturning Roe. Doing so do would remove the issue from the federal courts. Neither have the Republicans offered an amendment striking down privacy as a federal constitutional right. They had control of Congress and the Presidency, so why do nothing? Might I suggest that this issue provides a lot of fundraising dollars which would disappear if they resolved the issue?
I applaud Mr. Will for trying to calm the rabid rhetoric on abortion but that is all.
