One more Update on Smith and Ockomon

The Herald Bulletin is conducting one of its polls. More importantly the comments section is quite alive. Click here.

The Anderson Free Press reprints a press release from the Mayor's office that is a bit more expansive than the Herald Bulletin's new report. At least, the Mayor explained a bit why he was doing it. It has been a very long since I looked at any case law on the subject, but what the Mayor quotes gibes with my memory.

One of the AFP's comments asks how this could be if the temporary restraining order (TRO) was denied. Denying or granting a TRO has nothing to do with the substance of the lawsuit. Denying means that the technical grounds for stopping the swearing in did not exist.

I will try to see the court file tomorrow.
